We offer this website, including all information, tools, and services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. By accessing or using our Service, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service," "Terms"), including those additional policies referenced herein and/or available by hyperlink in the Footer of website (e.g., our Privacy Policy, Return & Cancellation Policy, Substitution Policy and Delivery Policy).

• Service Scope: Creative Gifting Solutions Pvt. Ltd., with its corporate office in Delhi, provides deliveries of perishable and non-perishable goods (Flowers, Cakes, Chocolates, Gifts, etc.) all over India, with the help of our service partners. We deliver products/items to consumers/recipients at specified delivery addresses on a requested delivery date.
SECTION 1 - Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or have consent to allow any of your minor dependents to use this site. You must not use products for any illegal purpose or violate any laws in your jurisdiction. You must not transmit any worms, viruses, or any code of a destructive nature. A breach of any of the Terms will result in an immediate termination of your Services.
SECTION 2 - General Conditions
We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission. You understand that, excluding encrypted credit card information, your content may be transferred unencrypted across networks. Headings used in this agreement are for convenience only.
SECTION 3 - Accuracy, Completeness, and Timeliness of Information
We are not responsible if information made available on this site is not accurate, complete, or current. We reserve the right to modify the contents of this site at any time. You agree that it is your responsibility to monitor changes to our site.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or any third-party for any modification, price change, suspension, or discontinuance of the Service.
SECTION 5 - Products, Delivery, and Risk Transfer
• Product Nature: Products or services are perishable and short-lived in nature, and are subject to claim, return or exchange only according to our Return & Cancellation Policy.
• Quality & Display: We make every effort to display products accurately; however, we cannot guarantee your monitor's or mobile phone, or tab’s display will be accurate. We do not warrant that the quality of any products will meet your expectations.
• Handcrafted Product Variance: You acknowledge and accept that all floral arrangements and fresh products are handcrafted by local service partners. Consequently, the final presentation, design, and aesthetic may vary from the website images, as the images are indicative representations and not exact guarantees of the finished product. This accepted variance is not grounds for a claim of damage or non-conforming product.
• Delivery Acceptance & Risk Transfer: We ensure the quality of goods and aim to deliver the order directly to the recipient. However, in cases where our delivery personnel cannot reach the recipient due to constraints (e.g., in offices, hospitals, public areas, or hotels), products will be handed over to the person as advised by the recipient or the Buyer, or any personnel (including reception, security, or concierge) authorized to accept items at the provided delivery address.
Risk of loss and title for products pass to the Buyer upon transfer of the product to this accepting agent/personnel at the specified delivery location.
• Substitution: The flower arrangements shown are indicative. Actual arrangements may vary. If ordered items are not available, we will deliver the best available quality of equal or higher value according to our separate Substitution Policy.
• Personalized Messages Disclaimer: We facilitate personalized messages for the greeting card and the cake. The quality of printing, card design (due to local printer variance), and the cake message handwriting style (due to local baker variance) cannot be guaranteed. While we strive for accuracy, any inadvertent human error or mistake in the message is explicitly not liable to any claim of damage or refund, as it is a complimentary, non-core service dependent on third-party service partners.
• Customer-Provided Content Liability (Message Accuracy): The Buyer is solely responsible for the accuracy of all personalized content, including messages for greeting cards and cakes. Floraindia is not liable for any spelling, grammatical, or content errors in the message text provided by the Buyer, and such errors do not constitute grounds for a product defect or refund claim.
• Natural and Color Variance Acceptance: The Buyer acknowledges and accepts that all fresh products are subject to natural color variance, and the handcrafted aesthetic integrity (e.g., shape, shade, wilting/melting) may be affected by transit and weather conditions. Such variances or minor defects are not considered grounds for non-conforming goods or a refund claim, as detailed in our Substitution & Quality Assurance Policy.
• Packaging and Presentation Variance: You accept that all non-essential presentation elements—including but not limited to decorative leaves, basket/vase type, wrapping papers, ribbons, and ancillary props—are subject to substitution based on local availability. Any variance in the color, quantity, or size of these indicative materials does not constitute a product defect and will not be eligible for refund or claim.
• Delivery Restrictions: We do not accept orders for delivery at Airports or Railway Stations. Specific rules regarding delivery timings, recipient contact, and failed delivery are detailed in our Delivery Policy & Procedures.
• Refund Claim Limit: Delivery of certain items may not be possible under uncontrollable circumstances. The Buyer always has the right to receive a 100% refund in such cases. No claim of whatsoever nature under any circumstances will be tenable other than the claim for a 100% refund of payment made for a particular order. All such claims, if any, are to be raised within one calendar day (24 hours) of delivery/non-delivery.
SECTION 6 - Accuracy of Billing and Account Information
• Right to Refuse/Limit: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you.
• Account Accuracy & Contact Mandate: You agree to provide current, complete, and accurate purchase, shipping, and account information, including a mandatory, direct contact number (with country code) for the Buyer/Sender placing the order. This number must be verifiable and operational at the time of delivery.
Failure to provide an accurate and functional Buyer/Sender contact number may result in the order being placed on hold or cancelled without liability for wrong/delayed delivery.
• Taxes: We agree to bear all the taxes, charges, and fees payable to any Government Authorities in respect of the goods.
Fraudulent Transaction Handling and Payment Risk:
• Fraudulent Order Hold/Cancellation: We reserve the right to place any order on indefinite hold or immediately cancel an order if we suspect the purchase involves a fraudulent payment method or misuse of a credit card. In such cases, we do not guarantee any form of refund to the person placing the fraudulent order.
• Delivered Fraudulent Order Defense: If an order placed using a fraudulent payment method is successfully delivered before the fraud is confirmed, Floraindia will not issue a refund for the service and product rendered. Since the service was completed in good faith, the merchant has fulfilled its contract. We will defend any associated chargeback by submitting proof of delivery to the financial institutions, as the financial dispute is primarily between the cardholder and their issuing bank.

SECTION 7 - User Comments, Feedback, and Other Submissions
You agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use any comments or submissions you forward to us. We are under no obligation to maintain comments in confidence or pay compensation. You agree that your comments will not contain unlawful, abusive, obscene material, or malware. We may, but have no obligation to, monitor or remove objectionable content.
